Welcome to Cudo Equestrian, LLC (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, www.cudoequestrian.com (“Site”), and any related services provided, including but not limited to riding lessons, the Pony Pool program, horsemanship classes, evaluations, camps, and other educational offerings (“Services”).
By accessing or using our Site and Services, you agree to comply with and be bound by these Terms, our Privacy Policy, and any other applicable agreements or policies. If you do not agree, you may not use our Site or Services.
1. Definitions
• Client/Participant/You/Your: Any individual or entity who accesses the Site or registers for Services.
• Services: All equestrian-related activities provided by Cudo Equestrian, LLC, including riding lessons, horsemanship classes, leasing (Pony Pool), clinics, camps, evaluations, and events.
• Pony Pool: A horse leasing and access program managed in collaboration with Angelica Run Farm.
• Site: The website www.cudoequestrian.com and all associated online communications and platforms.
2. Services Provided
Cudo Equestrian, LLC offers the following Services, subject to instructor availability and discretion:
• Evaluation Sessions: Initial assessments to determine rider suitability and placement.
• Private and Group Riding Lessons: Structured lessons based on age, discipline, and experience.
• Unmounted Horsemanship & Equine Management: Instruction in horse care, grooming, handling, feeding, safety, and stable practices.
• Pony Pool Leasing Program: Horse access via a leasing arrangement managed through Angelica Run Farm (under separate agreement).
• Clinics, Competitions, Camps, and Intensives: Specialty programs offered seasonally or by invitation.
Additional forms, waivers, or contracts may be required for participation. We reserve the right to adjust, suspend, or discontinue Services at our sole discretion and without prior notice.
3. Eligibility and Participant Responsibilities
3.1 Age and Consent
Participants must be 18 years or older to enroll directly. Minors may participate with the written consent of a parent or guardian.
3.2 Registration and Medical Disclosure
Accurate and complete registration forms must be submitted before participation. All relevant health, allergy, and emergency information must be disclosed and updated promptly if changes occur.
3.3 Safety and Conduct
All participants must:
• Wear ASTM/SEI-certified helmets, heeled boots, breeches/jodhpurs, and gloves.
• Arrive 30 minutes before lesson time for grooming and tacking.
• Follow staff directions and posted rules at all times.
• Treat all horses, staff, and other clients with respect.
• Not feed any animals without explicit permission.
Cudo Equestrian reserves the right to suspend or terminate Services for misconduct, safety violations, or policy breaches, without refund.
3.4 Supervision
Children under 16 must be accompanied by a parent or guardian when not in an active lesson or supervised program. Visitors may be asked to sign a waiver and must follow all barn rules.
4. Tuition, Fees, and Billing Policies
4.1 Payment Methods
• A valid credit or debit card must be kept on file via Stripe.
• Monthly tuition is charged automatically on the 1st of each month.
4.2 Fee Structure
• Tuition covers instruction only; horse access is billed separately through the Pony Pool.
• Maintenance and leasing fees are managed by Angelica Run Farm under separate agreements.
• Fees for additional activities (e.g., camps, clinics, shows) are charged separately.
• Fee changes require 30 days’ notice.
4.3 Refunds and Credits
• All payments are non-refundable, including for illness, injury, vacation, or weather-related cancellations.
• Missed or forfeited lessons are not eligible for credit or rescheduling.
• Clients acknowledge that payment signifies acceptance of these terms in accordance with Virginia Code: 59.1-200.
4.4 Delinquent Accounts
• Overdue accounts may result in suspended services.
• Returned or declined payments are subject to a $35 administrative fee.
5. Scheduling and Cancellations
5.1 Lesson Scheduling
• Students are assigned a consistent weekly time slot.
• Missed or unused lessons are not rescheduled or credited.
5.2 Cancellations
• Company-Initiated: If we cancel a lesson without a substitute instructor, a makeup may be offered.
• Weather: In the case of inclement weather, lessons may be replaced with virtual or unmounted sessions.
• Client-Initiated: Clients may request one permanent lesson time change every 90 days, subject to availability.
• Termination: To cancel enrollment, written notice must be provided at least 30 days in advance via email (office@cudoequestrian.com). Failure to do so will result in continued billing.
5.3 Company Rights
We reserve the right to deny or discontinue Services at any time for any reason, including safety concerns, payment delinquency, or disruptive behavior.
6. Safety Rules and Conduct
• Follow all grooming, tacking, and equipment protocols.
• Never leave equipment, tack, or personal items near horses unattended.
• Use cross-ties properly and never tie horses to fences or gates.
• Wear appropriate attire; no open-toed shoes or dangling accessories.
• No smoking, drugs, or alcohol permitted on the premises.
• Report all injuries, incidents, or hazards immediately.
Violation of safety rules may result in dismissal from the premises without refund.
7. Assumption of Risk and Release of Liability
Participation in equestrian activities involves inherent risk of injury or death.
Under the Virginia Equine Activity Liability Act (Code of Virginia: 3.2-6200 et seq.), all participants acknowledge these risks and agree to release Cudo Equestrian, LLC, Angelica Run Farm, and their staff, volunteers, and affiliates from liability, except in cases of gross negligence or willful misconduct.
All participants (or their legal guardians) must sign a waiver prior to participation.
8. Intellectual Property
All materials on the Site, text, images, logos, videos, curriculum, and training materials—are the sole property of Cudo Equestrian, LLC.
Reproduction, distribution, or use without express written permission is strictly prohibited.
9. Privacy and Data Security
We value your privacy and protect your information in accordance with our Privacy Policy.
While we take reasonable steps to secure your data, no system is 100% secure. By using our Site or Services, you consent to our data practices.
10. Communication and Automated Messaging Consent (TCPA)
By submitting your contact information, you agree to receive communications related to scheduling, billing, programming, and marketing.
Messages may be sent via automated technology in compliance with the Telephone Consumer Protection Act (TCPA).
To opt out of marketing messages, email us or reply “STOP” to any text. Essential and billing-related messages may still be sent.
11. Third-Party Links and Services
Our Site may contain links to third-party platforms such as Stripe and Angelica Run Farm.
We are not responsible for the privacy, terms, or functionality of third-party sites. Use them at your own discretion.
12. Indemnification
You agree to indemnify and hold harmless Cudo Equestrian, LLC and its affiliates from any claims, damages, or expenses arising from your use of the Site or Services, or any violation of these Terms.
13. Limitation of Liability
To the maximum extent permitted by law, Cudo Equestrian, LLC is not liable for:
• Indirect, incidental, or consequential damages,
• Loss of data, revenue, goodwill, or business opportunity,
• Personal injuries or property loss arising from participation in equestrian activities.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the Commonwealth of Virginia.
All legal actions must be filed in the courts of Fairfax County, Virginia. You waive the right to dispute jurisdiction elsewhere.
15. Changes to Terms
We may update these Terms at any time. Changes will be posted on the Site with the revised Effective Date.
Continued use of the Site or Services constitutes acceptance of any changes.
16. Severability
If any part of these Terms is deemed unenforceable, all other provisions shall remain in full effect.
